Federal High Court Rejects Samuel Anyanwu’s Request to Restrain INEC from Acting on His Removal

The Federal High Court in Abuja on Wednesday rejected the request by the  National Secretary of the Peoples Democratic Party (PDP) Samuel Anyanwu, to prevent the Independent National Electoral Commission (INEC) from acting on his removal from office.

Justice Inyang Ekwo, presiding over the case, ruled that while Anyanwu had established a case of urgency, his request for an ex-parte injunction would not be granted. Instead, the judge directed Anyanwu to notify INEC and other relevant defendants to allow them the opportunity to respond to the matter.

Through his lawyer, Ken Njemanze (SAN), Anyanwu had filed an application seeking to stop INEC or its agents from acting upon any correspondence or submissions from the PDP unless signed by him. He also sought an order to prevent the PDP chairman, Ambassador Umar Damagun, from forwarding any documents to INEC without his signature.

Justice Ekwo emphasized the importance of hearing from the defendants before making any decisions and scheduled the case for hearing on February 24.
