Appeal Court Rules FRSC Has No Power to Seize Driver’s Licences or Vehicles

In a landmark decision, the Court of Appeal has ruled that the Federal Road Safety Corps (FRSC) lacks the constitutional authority to seize drivers’ licences or impound vehicles of road users in Nigeria.

The judgment, delivered in Lagos, stems from a case brought by a motorist who challenged the FRSC’s powers after his vehicle and licence were confiscated during a routine stop.

The court held that while the FRSC is empowered to enforce traffic regulations and ensure road safety, it does not possess judicial or penal authority to carry out seizures or impose punishments without due process.

Justice Jamilu Yammama Tukur, delivering the lead judgment, emphasized that such actions infringe on citizens’ rights and exceed the agency’s statutory mandate. He added that only a competent court of law can impose penalties such as licence suspension or vehicle forfeiture.

Legal analysts say the ruling reaffirms the principle of separation of powers and could reshape how traffic law enforcement is conducted across the country.
