Detained in The Hague, Duterte Clinches Davao Mayoral Win in Stunning Political Twist

Despite being behind bars at the International Criminal Court (ICC), former Philippine President Rodrigo Duterte has staged an astonishing political comeback, securing a landslide victory in the Davao City mayoral race, according to preliminary results released Monday.

With more than 60% of votes counted, Duterte holds an overwhelming lead of 405,000 to just 49,000 over his nearest rival—an electoral rout that reasserts his enduring influence in his hometown of 1.8 million people, despite being under indictment for crimes against humanity at the International Criminal Court (ICC).

The 80-year-old strongman was arrested in March and flown to the Netherlands to face charges related to his deadly anti-drug campaign, which left thousands dead and drew global condemnation. His late entry into the mayoral race, just weeks before election day, sparked both controversy and curiosity—but clearly reignited support among his fiercely loyal base.

Still, the legal path forward is murky.

His daughter, impeached Vice President Sara Duterte, said on election day that legal teams were coordinating with the ICC to allow her father to be sworn in before the June 30 deadline. “His ICC and Filipino lawyers are discussing how to have him officially take his oath as Davao mayor,” she said.

Yet constitutional scholars warn that his detention abroad poses a serious barrier to assuming office. “You can’t run a city like Davao from a prison cell in Europe,” said political analyst Michael Henry Yusingco. “If he cannot physically perform his duties, the law is clear—the vice mayor steps in.”

That post may soon belong to his son, Sebastian “Baste” Duterte, who relinquished his re-election bid for mayor to allow his father’s return. Now, the younger Duterte appears set to become vice mayor, potentially acting as de facto leader should legal challenges stall his father’s oath-taking.

Observers note this isn’t the first time a Filipino politician has governed from behind bars. Former senator Leila de Lima, jailed during Duterte’s presidency on charges widely seen as politically motivated, remained active while imprisoned. But the logistical and legal hurdles facing Duterte at the ICC are on a different scale.

“The Duterte brand is uniquely tied to Rodrigo himself,” Yusingco added. “Even his children can’t fully inherit the political mystique he commands. And charisma can’t override court rulings.”

The unfolding scenario in Davao is shaping up to be a defining test of legal boundaries, democratic processes, and political legacy in a country long shaped by strongman politics.
